Aircraft Registration

The register is open to private jets, commercial airliners, helicopters, and aircraft under construction. Non-EU owners must appoint a Malta-based resident agent — a role Acumum Advisory can fulfil.

Registration process (managed by the Civil Aviation Directorate, Transport Malta):

  1. Reservation of registration marks (e.g., 9H-XXX)
  2. Submission of application, proof of ownership, and due diligence documentation
  3. Technical inspection and EASA airworthiness review
  4. Issuance of Certificate of Registration

With documentation in order, registration can typically be completed within a few weeks.

Tax & Fiscal Benefits

  • Investment tax credits available for businesses involved in aircraft repair, overhaul, and maintenance; unutilised credits may be carried forward

Finance & Leasing


  • Operating leases: lessor taxed on full lease income; lessee can deduct 100% of lease payments (both where responsible for maintenance)
  • Finance leases: lessor taxed on interest portion only; lessee regarded as owner and may deduct finance charges, maintenance costs, insurance, and claim tax depreciation
  • Depending on structure, importation of aircraft into the EU may be arranged with no VAT levied.

Aircraft Operating Certificate (AOC)

An AOC is the mandatory approval required to conduct commercial air transport in Malta and across the EU (Council Regulation 1008/2008). It confirms the operator has the professional ability and organisational structure to ensure safe operations.

Note: Applications must be submitted at least 90 days before intended operations begin.

Main requirements:

  • Principal place of business (and registered office, if any) must be in Malta
  • Must satisfy the CAD of the ability to conduct safe operations
  • Must appoint an accountable manager and nominate persons responsible for flight operations, crew training, ground operations, and continuing airworthiness

5-stage certification process:

  1. Pre-application — preliminary discussions with CAD; submission of Pre-Assessment Statement (POPS form)
  2. Application — formal AOC application filed; evaluation of manuals, training, facilities, aircraft, crew, and management
  3. Evaluation — detailed examination of all documentation and manuals
  4. Inspection and demonstration — inspection of facilities, training programmes; operational demonstrations required
  5. Certification — AOC issued once all requirements satisfied

Air Operator’s Licence (AOL)


Every AOC holder must also obtain an AOL — the commercial licence addressing business structure, ownership, and financial viability. An AOL can be issued within a maximum of 3 months from receipt of all required information.

Key conditions include: principal place of business in Malta; valid AOC; one or more aircraft at disposal; more than 50% owned and effectively controlled by EU nationals; compliance with financial, insurance, and good repute requirements under Articles 5, 7, and 11 of Regulation 1008/2008.
