Malta as a Maritime Jurisdiction


Malta’s shipping register is Europe’s largest and one of the largest globally, on the white list of both the Paris and Tokyo MOUs. Its legal framework is rooted in English maritime law, and Malta has adopted all major international conventions including SOLAS, MARPOL, the Tonnage Convention, and COLREGs.

Malta Shipping Companies

A Shipping Organisation under the Merchant Shipping Act offers a corporate structure specifically tailored to vessel ownership, with significant fiscal advantages.

Registration Process


All vessel registrations begin with provisional registration (valid 6 months, extendable), allowing the vessel to operate under the Malta flag immediately while final documentation is prepared.

Required documents include: application form and fee, proof of ownership, sworn declaration of ownership, Bill of Sale, appointment of resident agent (for international owners), Ship Radio Station Licence, and cancellation of previous registry.

Permanent registration follows upon submission of all remaining documents, including survey certificates and required vessel markings. Renewable annually.

Yacht Registration

Malta claims the title of largest superyacht registry in the world. Any person or company, irrespective of nationality, may register a yacht in Malta. Any vessel larger than 6m is eligible.

  • Pleasure yachts — private use only; fewer formalities
  • Commercial yachts — for charter; governed by the applicable code: 
    • Commercial Yacht Code: vessels over 15m
    • Small Commercial Yacht Code: 12–24m, max 12 passengers
    • Commercial Passenger Yacht Code: carries 12–36 passengers on international voyages
  • Commercial registration allows VAT set-off on expenses against charter VAT, improving cash flow
  • Switching between private and commercial registration is permitted, with no limit on switches
  • Provisional registration typically completed within 2–3 working days

Yacht Management

Ship Registration


Malta accommodates all types of merchant ships — tankers, bulk carriers, container ships, passenger vessels, floating platforms — as well as ships under construction and bareboat charters.

  • Bareboat charter registration: available for foreign vessels under the Malta flag, and for Maltese vessels under a foreign flag, subject to compatibility of legal systems
  • Ships under construction: registrable, protecting the rights of both builder and prospective owner
  • Mortgages: registrable and ranked by order of filing
  • Vessel age guidelines: vessels over 25 years generally not registered; 15–25 year vessels require inspection prior to registration
  • Tonnage Tax Scheme: EU-approved system taxing shipping organisations on net tonnage rather than profits — significant fiscal certainty for shipowners.
